Florida Apparently Believes the New SCOTUS will Overturn Everything

In 1976 the Supreme Court unequivocally stated that it is unconstitutional for a state to make the death penalty mandatory for a category of crime.  It was a 5 to 4 decision but Roberts v. Louisiana, 428 U.S. 325 (1976) has been the law for 50 years. 

Nevertheless, the state of Florida has not only enacted a mandatory death statute for “unauthorized aliens" who commit capital offenses but is now testing the law by indicting a man who allegedly killed his sister-in-law.  The man’s name is Shahidul Islam.
